Mykola Tomenko, Deputy Chairman of The Verkhovna Rada of Ukraine, believes that one of the goals of amendments to the Law on Tender is to conceal the flow of government funds from the public. He made the foregoing statement, commenting upon adoption of the Law on Amendments to several Legislative Acts of Ukraine on Public Procurement (Reg. No. 7532).
Dwelling upon the adopted amendments, M.Tomenko stated, "There are definitely some positive results concerning a number of provisions, whereby tenders are impossible or absurd for specific types of business, such as cinematography, concert activity, functioning of humanitarian and social establishments in rural areas and small towns."
However, the Deputy Chairman stressed that one of the key issues of the Law is its intention to conceal the tender procedure and its outcome. M.Tomenko stated that the applicable clause "promulgation of the information on procurement" was actually reduced to the minimum. The paragraphs 5, 8, 10, 11, 13, 14 and 15 on the promulgation of full information concerning the tender procedure were excluded. The Law abolishes the provisions on the promulgation of information on rejecting the bid, qualification or price quotation, reports on the results of the tender, tender documentаtion, protocol of disclosure of bids, information on rejection of bids, etc.
M.Tomenko considers the provision on public procurement without tender "in the event of special economic and social circumstances" to be another attempt to get round the tender procedure.
